Gallery Aurora Terms of Service

Important: Please read these Terms carefully. By using Gallery Aurora, you acknowledge that you have read, understood, and agreed to these Terms of Service.
1. Acceptance of Terms
By accessing or using Gallery Aurora ("Gallery Aurora," "GA," "Service," "Platform," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
Gallery Aurora reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or through the Platform.
2. Description of Service
Gallery Aurora is a photo hosting and distribution platform designed for creators, authors, artists, and professionals. The Service allows users to:
- Upload and store digital images
- Create private or public photo albums
- Generate QR codes for album access
- Control access to private albums
- Distribute public albums at scale
- Track usage, views, and bandwidth consumption
Gallery Aurora operates on a usage-based model with defined limits and enforcement mechanisms to ensure platform sustainability.
3. Account Registration and Eligibility
3.1 Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account or use the Service. By registering, you represent and warrant that you meet this requirement.
3.2 Account Creation
To access paid features, you must create an account and provide accurate, current, and complete information. You agree to keep your account information updated at all times.
3.3 Account Responsibility
You are solely responsible for all activity occurring under your account, including usage, content, charges, and access permissions. You are responsible for maintaining the confidentiality of your login credentials and for notifying Gallery Aurora immediately of any unauthorized access.
3.4 Account Suspension or Termination
Gallery Aurora may suspend or terminate accounts that violate these Terms, engage in abusive behavior, fail to pay fees, or present legal, security, or financial risk to the Platform.
4. Subscription Plans and Billing
4.1 Private Album Plans
Private album plans are billed monthly at the price displayed at checkout and include:
- One private album per subscription
- Up to 500 images
- Up to 1 GB of storage
- Up to 10 GB of monthly bandwidth
- Up to 25 individual, revocable QR codes
Private albums are invite-only and are not indexed or publicly accessible.
4.2 Public Album Plans
Public albums are designed for high-traffic distribution and include:
Public Album Plan – $9.99/month
- One public album
- Up to 100 images
- One public QR code
- Up to 10,000 views per month
Public Pro Plan – $19.99/month
- Up to 250 images
- Up to 50,000 views per month
- Priority delivery and support
Public albums are accessible without authentication and are subject to strict view-based limits.
4.3 Add-Ons
- Additional QR Code Packs (Private Plans only): $1.99 per 25-pack
4.4 Billing and Payments
Subscriptions are billed monthly in advance via Stripe. You must maintain a valid payment method on file. Failed payments may result in service suspension or album access being paused.
4.5 Overage Charges – Private Albums
Private album plans include a defined monthly bandwidth allowance.
- Usage exceeding the included bandwidth is billed at $1.00 per additional gigabyte.
- If automatic overages are disabled, album access pauses when the limit is reached.
- Bandwidth usage is calculated using Gallery Aurora's internal measurement systems, which are final.
4.6 Overage Charges – Public Albums
Public albums are billed by view count, not storage.
- $1.50 per additional 1,000 views, or
- $10.00 per additional 10,000 views
Users may enable or disable automatic overage billing. If overages are disabled, public album access pauses at the included view limit. Overages may be billed automatically during or at the end of the billing cycle.
4.7 Refund Policy
All fees are non-refundable. No refunds are issued for partial months, unused bandwidth, or unused views. Cancellations take effect at the end of the current billing period.
4.8 Price Changes
Gallery Aurora reserves the right to modify pricing with 30 days' notice. Price changes apply to future billing cycles only.
5. User Content and Intellectual Property
5.1 Ownership
You retain ownership of all content you upload ("User Content"). Gallery Aurora does not claim ownership of your content.
5.2 License to Gallery Aurora
You grant Gallery Aurora a limited, non-exclusive, worldwide license to host, store, process, transmit, and display your content solely for the purpose of operating the Service.
5.3 Representations
You represent that you own or have legal rights to all User Content and that it does not violate laws or third-party rights.
5.4 Prohibited Content
You may not upload content that is illegal, abusive, obscene, defamatory, infringing, harmful, or that depicts minors in inappropriate contexts.
5.5 Content Moderation
Gallery Aurora reserves the right to remove content or suspend accounts that violate these Terms.
5.6 Backups
Gallery Aurora does not guarantee content preservation. You are responsible for maintaining your own backups.
6. DMCA Copyright Policy
Gallery Aurora complies with the Digital Millennium Copyright Act. DMCA notices must be sent to:

Repeat infringers will have their accounts terminated.
7. Acceptable Use Policy
7.1 Prohibited Activities
You may not:
- Circumvent usage limits
- Hotlink images to external high-traffic sites
- Use bots or automated tools
- Attempt to breach security
- Resell the Service without authorization
7.2 Usage Enforcement
Gallery Aurora enforces hard caps on bandwidth and views. Usage metrics are determined exclusively by Gallery Aurora's internal systems and are final.
7.3 Abuse
Deliberate attempts to inflate traffic, evade billing, or abuse the Service may result in immediate suspension or termination.
8. Privacy and Data Protection
Your use of the Service is governed by the Gallery Aurora Privacy Policy. We collect account, usage, and technical data necessary to operate the Service. While we use reasonable safeguards, no system is completely secure.
9. Gallery Aurora Intellectual Property
All platform software, branding, designs, and systems are owned by Gallery Aurora. You may not copy, modify, reverse-engineer, or misuse them.
10. Third-Party Services
Gallery Aurora integrates third-party services such as Stripe and Cloudflare. We are not responsible for third-party systems or outages.
11. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available." Gallery Aurora disclaims all warranties. To the maximum extent permitted by law, our total liability is limited to the amount you paid in the prior 12 months.
12. Indemnification
You agree to indemnify and hold harmless Gallery Aurora from claims arising from your use of the Service, your content, or your violations of these Terms.
13. Termination
You may terminate your account at any time. Gallery Aurora may terminate accounts for violations, non-payment, or legal or security risks. Outstanding fees remain payable.
14. Dispute Resolution
These Terms are governed by the laws of [State/Province, Country]. Disputes are resolved by binding arbitration, except where prohibited by law. Class actions are waived.
15. General Provisions
These Terms constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect. Force majeure events excuse performance delays.
