IMPORTANT NOTICE: By accessing or using Gallery Aurora, you agree to these Terms of Service. If you do not agree, do not use the Service.
1. Acceptance of Terms
Gallery Aurora ("Gallery Aurora," "GA," "Service," "Platform," "we," "us," or "our") is operated by C5M (Continent 5 Media Group, Inc.). These Terms of Service ("Terms") govern your access to and use of the Service. By creating an account, purchasing a subscription, uploading content, generating QR codes, or otherwise using the Service, you agree to be bound by these Terms.
We reserve the right to modify, update, or replace these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be posted within the Platform and take effect upon posting.
2. Description of Service
Gallery Aurora is a subscription-based photo album platform that allows users to create, store, and share digital image albums using QR codes. The Service supports two album types:
Private Albums:
Restricted-access albums shared through revocable QR codes that you control through your dashboard.
Public Albums:
Mass-distribution albums accessed through permanent, non-revocable QR codes and governed by monthly bandwidth limits.
The Service operates on defined storage, file size, and bandwidth limits that are strictly enforced to ensure platform stability and cost sustainability.
3. Account Registration and Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By registering, you represent that you meet this requirement.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for all activity occurring under your account, including content uploads, usage, charges, and access permissions.
You are responsible for maintaining the confidentiality of your login credentials. Gallery Aurora is not responsible for unauthorized access resulting from your failure to secure your account.
4. Subscription Plans and Billing
4.1 Private Album Plans
Standard Plan: $3.00 per month or $30.00 per year
- 1 private album per subscription
- Up to 500 photos maximum
- Up to 10 MB per photo
- Up to 5 GB total storage
- Up to 500 image swap-outs per 30-day cycle
- 25 revocable QR access codes included
- Bandwidth included for normal private sharing
- Private access only (invite-based)
Plus Plan: $5.00 per month or $50.00 per year
- 1 private album per subscription
- Up to 1,000 photos maximum
- Up to 10 MB per photo
- Up to 10 GB total storage (implied: 1,000 photos × 10 MB)
- Up to 1,000 image swap-outs per 30-day cycle
- 50 revocable QR access codes included
- Bandwidth included for normal private sharing
- Private access only (invite-based)
Image swap-outs allow you to replace existing photos with new ones. Each replacement counts as one swap-out. Swap-out counters reset every 30 days from your subscription start date.
Private albums are intended for low-volume, controlled sharing with specific individuals. Usage patterns that significantly exceed normal private sharing bandwidth may be flagged for review.
4.2 Public Album Plans
Public Album Plan: $10.00 per month or $100.00 per year
- 1 public album per subscription
- Up to 100 photos maximum
- Up to 10 MB per photo
- Up to 1 GB total storage
- 1 permanent, non-revocable public QR code
- 50 GB monthly bandwidth included
- Public access for anyone with QR code
Public albums are designed for mass distribution such as event galleries, portfolios, or public-facing content. Once a public QR code is generated, it cannot be revoked. Access is governed by bandwidth limits, not individual viewer permissions.
4.3 Add-Ons
Bandwidth Add-On (Public Albums Only):
- $2.00 per additional 10 GB
- Available for purchase when you reach your 50 GB monthly limit
- Can be purchased multiple times per billing cycle
- Resets at the start of each billing cycle
- Does not roll over to future billing cycles
QR Code Pack (Private Albums Only):
- $2.00 per 25 additional QR codes
- Provides additional revocable QR codes beyond your plan's included amount
4.4 Billing and Payments
All subscriptions are billed in advance through Stripe, our payment processor. You must maintain a valid payment method on file. Failed or disputed payments may result in suspension or termination of Service.
Monthly subscriptions are charged on a recurring monthly basis on the same day each month. Annual subscriptions are charged as a single upfront payment for 12 months of service.
You authorize Gallery Aurora to charge your payment method for all fees incurred under your account.
4.5 Refund Policy
Annual plans: Refunds may be available within 30 days of initial purchase, at Gallery Aurora's discretion. After 30 days, annual subscription fees are non-refundable.
Monthly plans: Monthly subscription fees are non-refundable once charged.
No refunds are provided for:
- Partial billing periods
- Unused storage
- Unused bandwidth
- Unused QR codes
- Unused swap-outs
- Early termination after the refund window
- Account suspension or termination due to Terms violations
Refunds, when granted, will be issued to the original payment method within 10 business days.
4.6 Cancellation
You may cancel your subscription at any time through your account dashboard. Upon cancellation:
- Your subscription remains active until the end of your current billing period
- You retain full access to your album until the billing period ends
- Automatic renewal is disabled
- No refunds are issued for the remaining portion of your billing period
After your billing period ends, your album will become inaccessible, but your account data will be retained for 90 days in case you wish to reactivate.
4.7 Price Changes
Gallery Aurora reserves the right to change subscription pricing at any time. Price changes will be communicated via email at least 30 days before taking effect. Price changes apply only to new subscriptions or renewals after the effective date. Your current subscription will be honored at the original price until the end of your current billing period.
4.8 Mandatory Branding and Navigation
Users acknowledge and agree that Gallery Aurora maintains a permanent brand presence on all hosted content. Regardless of whether an album is "Private" or "Public," the Platform will display a static Gallery Aurora logo. Every album page will feature a mandatory link labeled "Explore Gallery Aurora" which serves as a pathway for viewers to return to the main Platform landing page. Users may not attempt to hide, obscure, or remove these elements.
Users of Gallery Aurora's Public Albums acknowledge and agree that Gallery Aurora maintains a "Nadica" assistant icon on every page. This AI can only answer questions about Continent 5 Media (C5M) and its ecosystem.
5. File Upload Restrictions
5.1 Allowed File Formats
Only the following image formats are permitted:
- JPG / JPEG
- PNG
- HEIC (iPhone/iOS native format)
5.2 Prohibited File Formats
RAW and camera-native formats are strictly prohibited, including but not limited to:
- .raw, .dng, .nef, .cr2, .cr3, .arw, .orf, .rw2, .raf, .pef, .srw, .x3f, and any other professional camera RAW formats
Reason for prohibition: RAW files are professional editing formats that are 5-10x larger than standard web image formats. They are designed for photo editing software, not web sharing. Gallery Aurora is optimized for web-ready images. To share RAW photos, export them as JPG from your editing software (Lightroom, Photoshop, etc.).
5.3 File Size Enforcement
Maximum file size: 10 MB per photo
Files exceeding this limit will be rejected before upload completes. Most smartphone photos are 2-5 MB. High-quality photos from newer phones may be 6-8 MB. Our 10 MB limit accommodates nearly all web-ready photos.
5.4 Server-Side Validation
Gallery Aurora enforces file type and file size restrictions server-side through:
- File extension validation
- MIME type verification
- File header inspection
Attempts to bypass restrictions by renaming files (e.g., renaming .raw to .jpg), manipulating file metadata, or other circumvention methods will result in upload rejection and may result in account suspension or termination.
Files that pass frontend validation but fail server-side validation will be rejected with a clear error message.
6. Bandwidth Usage and Enforcement (Public Albums Only)
6.1 Bandwidth Measurement
Bandwidth is measured in gigabytes (GB) of data delivered to viewers when they access your public album. This includes all images, thumbnails, and other assets loaded when someone views your album through your public QR code.
Gallery Aurora does not use "views" or "page loads" as a billing or limit metric. Only actual data transfer (GB delivered) is measured and enforced.
Approximate calculation: If your public album contains 100 photos totaling 1 GB, then 50 GB of included bandwidth allows approximately 50 people to view your complete album each month. Actual usage will vary based on which photos viewers load and how many times they revisit.
6.2 Enforcement
Public album subscriptions include 50 GB of bandwidth per billing cycle (month or year, depending on your plan).
When you approach your bandwidth limit:
- At 80% usage (40 GB): You will receive an email and in-app notification warning you that you're approaching your limit
- At 100% usage (50 GB): Your album will be temporarily paused and image delivery will stop
When your album is paused due to bandwidth limits, you have two options:
- Purchase additional bandwidth: $2 per 10 GB, available immediately through your dashboard. Album delivery resumes automatically upon purchase.
- Wait for your next billing cycle: Your bandwidth counter resets automatically at the start of each billing cycle (monthly or annually), and album delivery resumes.
Your public QR code remains valid even when bandwidth limits are reached. Viewers attempting to access your album will see a message indicating the album has reached its bandwidth limit.
6.3 Bandwidth Tracking
Bandwidth usage is tracked in real-time per album. You can view your current bandwidth usage at any time through your account dashboard.
Gallery Aurora's bandwidth measurement systems are authoritative and final. Bandwidth consumption data is provided by our CDN (Content Delivery Network) provider and may include a processing delay of up to 24 hours.
6.4 No Bandwidth Rollovers
Unused bandwidth does not roll over to future billing cycles. At the start of each new billing cycle, your bandwidth counter resets to zero, regardless of how much bandwidth you used in the previous cycle. Purchased bandwidth add-ons also reset and do not roll over.
6.5 Private Album Bandwidth
Private albums include bandwidth for normal private sharing and are not subject to the 50 GB monthly cap. However, private albums are designed for low-volume, invite-only sharing. Usage patterns that indicate mass distribution, public sharing, or excessive bandwidth consumption (e.g., hundreds of viewers per month) may be flagged for review and could result in a requirement to upgrade to a public album plan.
7. Storage Limits and Photo Management
7.1 Storage Enforcement
Storage limits are enforced based on:
- Number of photos (hard limit based on your plan)
- Total storage space (calculated from file sizes)
- File size per photo (10 MB maximum per file)
When you reach your photo limit or storage limit, additional uploads will be rejected with an error message. You must delete existing photos before uploading new ones, or upgrade to a plan with higher limits.
7.2 Storage Notifications
You will receive notifications when you reach:
- 90% of your photo limit (e.g., 450 of 500 photos for Standard plan)
- 90% of your storage limit (e.g., 4.5 GB of 5 GB for Standard plan)
These notifications are sent via email and displayed in your dashboard.
7.3 Image Swap-Outs (Private Albums Only)
Private album plans allow you to swap out (replace) photos within your swap-out limit:
- Standard Plan: 500 swap-outs per 30-day cycle
- Plus Plan: 1,000 swap-outs per 30-day cycle
How swap-outs work:
- Deleting a photo and uploading a new one counts as 1 swap-out
- Your swap-out counter resets every 30 days from your subscription start date
- If you reach your swap-out limit, you must wait until the next 30-day cycle to replace more photos
- You can still delete photos without replacement at any time (this does not count as a swap-out)
Swap-out limits exist to prevent using private albums as unlimited rotating storage.
7.4 Public Album Management
Public albums allow up to 100 photos. You may delete and upload photos freely within this limit. Public albums do not have swap-out restrictions, but once your album is live and your QR code is distributed, significant changes to content may confuse viewers.
8. QR Codes
8.1 Private Album QR Codes
Private QR codes are revocable by you at any time through your account dashboard.
How private QR codes work:
- Each QR code provides access to your private album
- You control who has access by generating and distributing specific QR codes
- When you revoke a QR code, it immediately stops working
- Anyone attempting to use a revoked QR code will see a message: "This QR code has been revoked by the album owner"
- You can generate new QR codes after revoking old ones (subject to your plan's QR code limit)
- Revoked QR codes cannot be reactivated; you must generate a new code
Private QR codes are designed for controlled, invite-only sharing with specific individuals (family, friends, clients, etc.).
8.2 Public Album QR Codes
Public QR codes are permanent and non-revocable once generated.
How public QR codes work:
- Your public album receives one permanent QR code when created
- This QR code provides public access to anyone who has it
- The QR code cannot be revoked, changed, or disabled
- Even if your album reaches its bandwidth limit and is paused, the QR code URL remains valid (viewers will see a bandwidth limit message instead of your photos)
- You are solely responsible for where and how you distribute your public QR code
Warning: Do not share your public QR code publicly (social media, websites, printed materials, etc.) unless you intend for unlimited people to access your album. Public QR codes are designed for mass distribution scenarios like events, portfolios, business galleries, or public-facing content.
8.3 QR Code Security
QR codes generated by Gallery Aurora contain secure, unique identifiers. However:
- Private QR codes should only be shared with intended recipients
- Once a QR code is shared, Gallery Aurora cannot control who forwards or redistributs it
- For maximum security with private albums, revoke and regenerate QR codes periodically
- Do not post private QR codes in public forums, social media, or publicly accessible locations
9. User Content and Intellectual Property
9.1 Your Content Ownership
You retain full ownership of all photos, images, and content you upload to Gallery Aurora. Uploading content to the Service does not transfer ownership to Gallery Aurora.
9.2 License You Grant to Gallery Aurora
By uploading content, you grant Gallery Aurora a limited, non-exclusive, worldwide, royalty-free license to:
- Host and store your content on our servers
- Process and optimize your content for web delivery (compression, format conversion, thumbnail generation)
- Deliver your content to viewers who access your albums through QR codes
- Backup and replicate your content for redundancy and service reliability
This license exists solely to operate the Service and provide the features you've subscribed to. Gallery Aurora will not use your content for marketing, advertising, or any purpose beyond operating the Service, except with your explicit permission.
This license terminates when you delete your content or close your account, except for:
- Cached or backup copies, which will be deleted within 90 days
- Content required for legal compliance or dispute resolution
9.3 Your Representations
By uploading content, you represent and warrant that:
- You own all rights to the content, or have obtained all necessary permissions and licenses
- Your content does not violate any third-party intellectual property rights, privacy rights, or other legal rights
- Your content does not violate any applicable laws or regulations
- You have obtained necessary permissions from any individuals depicted in your photos (model releases, consent, etc.) where required by law
9.4 Content Responsibility
You are solely responsible for:
- The content you upload
- Who you share your albums with
- Any consequences arising from your content or sharing decisions
Gallery Aurora does not pre-screen or monitor user content. We are not responsible for user-generated content and do not endorse any content uploaded by users.
9.5 Prohibited Content
You may not upload content that:
- Violates intellectual property rights of others
- Contains child sexual abuse material (CSAM) or exploits minors in any way
- Promotes illegal activity
- Contains malware, viruses, or malicious code
- Violates anyone's privacy or publicity rights
- Harasses, threatens, or incites violence
- Contains graphic violence or gore (except in legitimate documentary or artistic contexts)
- Violates any applicable law
Uploading prohibited content may result in immediate account termination and reporting to law enforcement where legally required.
9.6 Content Backup and Preservation
Gallery Aurora does not guarantee content preservation or backup. While we implement reasonable data redundancy measures, technical failures, security incidents, or service discontinuation may result in data loss.
You are solely responsible for maintaining your own backups of any content you upload. Do not use Gallery Aurora as your only storage location for irreplaceable photos.
10. Prohibited Conduct
You may not:
Usage Violations:
- Circumvent or attempt to bypass storage, bandwidth, or file size limits
- Use automated tools, bots, scripts, or scrapers to access the Service
- Use private albums for mass public distribution or vice versa
- Share account credentials with others
- Create multiple accounts to evade limits or suspensions
Technical Violations:
- Hotlink images or embed Gallery Aurora-hosted images on third-party websites without permission
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Interfere with or disrupt the Service, servers, or networks
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or systems
- Probe, scan, or test the vulnerability of the Service
Commercial Violations:
- Resell, sublicense, or redistribute the Service without written authorization
- Use the Service to compete with Gallery Aurora or develop a competing product
- Frame or mirror any portion of the Service on another website
Content Violations:
- Upload prohibited content as defined in Section 9.5
- Upload content you don't have rights to
- Impersonate any person or entity
- Collect or harvest user information without consent
Other Violations:
- Violate any applicable laws or regulations
- Engage in fraudulent, abusive, or deceptive conduct
- Violate the rights of others
Violations may result in: Warning notice, temporary suspension, permanent account termination, deletion of content, referral to law enforcement where applicable, or legal action to recover damages.
11. Service Availability and Modifications
11.1 Service Availability
Gallery Aurora strives to provide reliable service, but we do not guarantee uninterrupted or error-free operation.
The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Technical issues
- Third-party service outages
- Security incidents
- Force majeure events
We will attempt to provide notice of scheduled maintenance when practical, but are not required to do so.
11.2 Right to Modify or Discontinue Service
Gallery Aurora reserves the right, at any time and for any reason, to:
- Modify features or functionality
- Change storage, bandwidth, or usage limits
- Suspend service temporarily or permanently
- Discontinue the Service entirely
Such modifications may be made:
- With or without notice
- For technical, financial, legal, security, or operational reasons
- At our sole discretion
11.3 Service Discontinuation
If Gallery Aurora permanently discontinues the Service, we will:
- Provide reasonable advance notice when possible (at least 30 days preferred, but not guaranteed)
- Allow you to download your content during a wind-down period (duration determined at our discretion)
In the event of service discontinuation:
- Refunds are not guaranteed and will be provided only as required by applicable law
- Prorated refunds for remaining subscription time may be offered at Gallery Aurora's discretion
- Gallery Aurora is not liable for any losses, damages, or costs arising from service discontinuation
12. Third-Party Services
The Service integrates with and relies on third-party service providers, including:
- Stripe (payment processing)
- Backblaze B2 (cloud storage)
- ImageKit (content delivery network and image optimization)
- Google Cloud Platform (application hosting and infrastructure)
- Other third-party services as needed for operations
Gallery Aurora is not responsible for:
- Outages, failures, or performance issues of third-party services
- Third-party pricing changes that affect our costs
- Data breaches or security incidents at third-party providers
- Third-party terms of service or privacy policies
- Actions or omissions of third-party service providers
You acknowledge that the Service's functionality depends on these third-party providers and that service interruptions may occur due to factors outside Gallery Aurora's control.
13. Privacy and Data Security
13.1 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
13.2 Data Security
Gallery Aurora implements industry-standard security measures to protect your data, including:
- 256-bit SSL/TLS encryption for data in transit
- Encrypted storage
- Secure authentication
- Regular security updates
However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of your data.
13.3 Your Responsibilities
You are responsible for:
- Keeping your login credentials secure
- Using strong, unique passwords
- Notifying us immediately of any unauthorized access
- Securing any devices used to access the Service
14. Disclaimers and Warranties
14.1 "As Is" and "As Available"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
14.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GALLERY AURORA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- TITLE
- ACCURACY OR COMPLETENESS
- UNINTERRUPTED OR ERROR-FREE OPERATION
- SECURITY
- CONTENT PRESERVATION
14.3 No Guarantees
Gallery Aurora does not warrant or guarantee that:
- The Service will meet your requirements
- The Service will be available at all times
- Results obtained from the Service will be accurate or reliable
- Errors or defects will be corrected
- The Service is free from viruses or harmful components
14.4 Jurisdiction-Specific Rights
Some jurisdictions do not allow certain warranty disclaimers. In such jurisdictions, the above disclaimers may be limited to the extent prohibited by law, and you may have additional rights.
15. Limitation of Liability
15.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GALLERY AURORA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE, THESE TERMS, OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GALLERY AURORA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15.2 Excluded Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GALLERY AURORA SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
- LOSS OF DATA OR CONTENT
- LOSS OF GOODWILL OR REPUTATION
- COST OF SUBSTITUTE SERVICES
- ANY DAMAGES ARISING FROM SERVICE INTERRUPTION, DISCONTINUATION, OR UNAVAILABILITY
This limitation applies regardless of:
- The legal theory (contract, tort, negligence, strict liability, or otherwise)
- Whether Gallery Aurora was advised of the possibility of such damages
- Whether the remedy fails of its essential purpose
15.3 Jurisdiction-Specific Rights
Some jurisdictions do not allow certain liability limitations. In such jurisdictions, the above limitations may be limited to the extent prohibited by law, and you may have additional rights.
16. Indemnification
You agree to indemnify, defend, and hold harmless Gallery Aurora, C5M, and their respective officers, directors, employees, agents, affiliates, and contractors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
- Your use or misuse of the Service
- Your content uploaded to the Service
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Any claims by third parties related to your albums or QR codes
This indemnification obligation survives termination of your account and these Terms.
Gallery Aurora reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.
17. Termination
17.1 Termination by You
You may cancel your subscription at any time through your account dashboard. Upon cancellation:
- Your subscription remains active until the end of your current billing period
- You retain full access until the billing period expires
- Automatic renewal is disabled
- No refunds are issued for the remaining time in your billing period (except as provided in Section 4.5)
After your billing period ends:
- Your album becomes inaccessible to you and all viewers
- Your content is retained for 90 days
- After 90 days, your content is permanently deleted
17.2 Termination by Gallery Aurora
Gallery Aurora may suspend or terminate your account immediately, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment or failed payment
- Risk to platform security or stability
- Extended inactivity
- Any reason at our sole discretion
Upon termination by Gallery Aurora:
- Your access is immediately revoked
- Your content may be immediately deleted
- You remain responsible for all fees incurred before termination
- No refunds are provided (except as required by law)
17.3 Effect of Termination
Upon termination (by either party):
- All licenses granted by you to Gallery Aurora terminate (subject to backup retention periods)
- All licenses granted by Gallery Aurora to you terminate immediately
- Your QR codes (private and public) stop working
- Outstanding fees remain due
- Sections of these Terms that by their nature should survive termination will survive (including Sections 9, 14, 15, 16, 18, and 19)
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Deleware, United States, without regard to conflict of law principles.
18.2 Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the formation, performance, breach, or termination thereof) shall be resolved through binding individual arbitration rather than in court, except as provided below.
Arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA).
You and Gallery Aurora agree to waive the right to a jury trial and the right to participate in class actions or class arbitrations.
18.3 Exceptions to Arbitration
- Either party may bring an action in small claims court if the claim qualifies.
- Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights or unauthorized access to the Service.
18.4 Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to support@c5m.world within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.
18.5 Jurisdiction and Venue
If arbitration does not apply or if you opt out, any legal action must be brought in the state or federal courts located in Deleware, and you consent to the exclusive jurisdiction of those courts.
19. General Provisions
19.1 Entire Agreement
